Marijuana Growers Exposed in March Are Transferred for Criminal Prosecution

Yesterday, 8 October 2018, the Tax and Customs Police Department of the State Revenue Service (hereinafter — “SRS”) transferred to the public prosecutor’s office the criminal proceedings initiated this March against a group of persons, which were engaged in the growing, sale and smuggling of marijuana in the border area of Lithuania on a large scale.

In March 2018, SRS officials, carrying out a search in the territory of a house in the border area of Lithuania, revealed that a marijuana farm was equipped in a greenhouse. In one of the greenhouse rooms, there were approximately 663 pcs. of 50cm-high marijuana plants, as well as everything necessary for their growing: heating, water supply, ventilation, air conditioning, power supply devices, air temperature measuring thermometers, flower pods and other objects, which were seized during the inspection.

Plants seized within the framework of the criminal proceedings were sent for a chemical expert-examination. The expert-examination confirmed that the seized plants were cannabis, i.e., marijuana. Their total amount was seven kilograms.

Persons involved in the crime — citizens of Latvia born in 1974 and 1985 — were recognised as suspects during the investigation, and a security measure which does not involve the deprivation of liberty is currently applied thereto.

During the pre-trial investigation, all necessary investigative activities were carried out to obtain a sufficient aggregation of eviidence and to be able to transfer the criminal proceedings for the commencement of criminal prosecution. On 8 October 2018, the criminal proceedings were sent to the Dobele District Prosecution Office for the commencement of criminal prosecution in connection with the constituent elements of the criminal offence stipulated in Section 253, Paragraph one1 and Section 256, Paragraph two2 of The Criminal Law.

1Section 253. Unauthorised Manufacture, Acquisition, Storage, Transportation and Forwarding of Narcotic and Psychotropic Substances

(1) For a person who commits unauthorised manufacture, acquisition, storage, transportation or forwarding of narcotic or psychotropic substances without the purpose of disposal of such substances, the applicable punishment is the deprivation of liberty for a period of up to three years or temporary deprivation of liberty, or community service, or a fine and with probationary supervision for a period of up to three years..

2 Section 256. Unauthorised Sowing and Growing of Plants Containing Narcotic Substances

(2) For a person who commits unauthorised sowing or growing of plants containing narcotic substances, over a large area, if it has been committed by an organised group, the applicable punishment is the deprivation of liberty for a period of up to five years or temporary deprivation of liberty, or community service, or a fine, with or without the confiscation of property.
