Excise Duty Guarantee

  • Excise Duty One-time Guarantee
    • The excise duty one-time guarantee is a value in monetary terms for covering a possible excise duty payable, in the event, following a receipt of excise goods, the excise duty is not paid for them. The excise duty one-time guarantee is required when a one-time receipt of excise goods from an EU member-state is planned or, in separate cases, for the goods delivery in the deferred excise duty payment mode.

      To receive the excise duty one-time guarantee certificate, a structured application must be submitted in the Electronic Declaration System (hereinafter - EDS) of the State Revenue Service, and a guarantee deposit must be paid to the following account of the Treasury: LV31TREL8135450000000 (SWIFT code: TRELLV22), or the insurance policy together with the payment confirmation document approved by the insurer for payment of the insurance premium provided in the policy or a guarantee letter from a credit institution must be attached.

      The excise duty one-time guarantee certificate is issued in the form of an electronic document, which is valid for one month.

      To comply with commitments regarding excise duty one-time guarantee and it could be used to receive a new excise duty one-time guarantee certificate, a structured application must be submitted in EDS to revoke or cancel excise duty one-time guarantee certificate.

      To have the guarantee amount refunded, one must submit an application in EDS, addressing it to the Excise Duty Goods Department.

      Having received the application, the State Revenue Service shall remit the paid guarantee deposit amount within 10 working days in the following sequence:

      • to cover the excise duty payable;
      • for excise duty payments which terms are extended;
      • to cover debt of other taxes payable or state fee payments;
      • for further excise duty payments;
      • to the account provided by the merchant.
  • Excise Duty General Guarantee
    • The excise duty general guarantee is a value in monetary terms for covering a possible excise duty payable, in the event a special permit (license) is received for activities with harmonised excise goods (tobacco products, alcoholic beverages) in the deferred tax payment mode.

      To receive the general guarantee certificate, a structured application must be submitted in the Electronic declaration system (EDS) of the State Revenue Service, and the insurance policy together with the payment confirmation document approved by the insurer for payment of the insurance premium provided in the policy or a guarantee letter from a credit institution must be attached, or a guarantee deposit must be paid to the following account of the Treasury:  LV31TREL8135450000000 (SWIFT code: TRELLV22).

      The procedure of using, administering and applying the excise duty general guarantee is determined by the Cabinet Regulations No.72 „Regulations on Excise Duty Securities” (dated 12th of February, 2019).

      The general guarantee certificate is issued as an electronic document. The validity period of the general guarantee certificate will not be longer than the validity period indicated in the liability performance policy or the credit institution guarantee letter but will not extend 12 months from the day when general guarantee certificate comes into force. However, if a merchant is making only the guarantee deposit contributions, the general guarantee certificate will be valid for an infinite period.
